In accordance with the Consumer Product Safety Improvement Act (CPSIA) of 2008, the Consumer Product Safety Commission (CPSC) issued a final consumer product safety rule requiring manufacturers of durable infant or toddler products (16 CFR 1130) to establish a consumer registration program on Feb 17, 2012. The rule is effective Feb 18, 2013.
Background
On Dec 29, 2009, CPSC published a final rule requiring manufacturers of durable infant or toddler products (74 FR 68668) to:
(1) Provide with each product a postage- paid consumer registration form;
(2) Keep records of consumers who register such products with the manufacturer;
(3) Permanently place the manufacturer’s name and contact information, model name and number, and the date of manufacture on each such product.
On Feb 22, 2010, CPSC published a correction notice (75 FR 7550).
On Aug 8, 2011, CPSC published a notice of proposed rulemaking to amend the rule in order to clarify or correct certain aspects of the rule (76 FR 48053).
The Clarifications and Corrections in the Final Rule
1. Simplifying the provisions for the format and text of registration forms
2. Clarifying the required font size
3. Changes the form to clarify that consumers should return the bottom part of the form only
4. Omitting manufacturer’s name on the back bottom of the form
5. Identifying a third party that is processing the forms
6. Clarifying the location where registration information is to be maintained
7. Correcting text requirement for purpose statement
8. Allow barcodes on registration forms
